These General Conditions of Sale (“CGV”) govern any transaction carried out on the site.quebecstore.ca operated by Tiguidou Web Creation / Quebecstore Inc. Any order implies acceptancefull and complete terms of these General Terms and Conditions.

2. Products and services offered
Tiguidou Web Creation offers digital products (templates, models, graphic packs, reports, etc.) as well as professional web creation services, graphic design, natural referencing (SEO), social media management and digital consulting.
Digital products are delivered as downloadable files. Professional services are the subject of a separate agreement or a formal submission.
Product descriptions, images and specifications are provided for informational purposes only. Tiguidou Création Web strives to ensure their accuracy without, however, guaranteeing their completeness.
3. Orders and contract formation
Any order placed via the quebecstore.ca website constitutes a binding purchase offer. The contract is formed when the Customer receives the order confirmation by email.
The seller reserves the right to refuse or cancel any order in the event of suspicion of fraud, incorrect information or unavailable product, without incurring liability.
For tailor-made services, the order is only confirmed upon receipt of a deposit or signature of a service contract.
4. Prices and taxes
All prices displayed on quebecstore.ca are in Canadian dollars (CAD) and exclude applicable taxes (GST and QST), unless explicitly stated otherwise.
Applicable taxes (GST 5% + QST 9.975%) will be calculated and displayed at the time of payment in accordance with Quebec tax legislation.
Prices are subject to change at any time without notice, but changes do not apply to orders already confirmed.
5. Payment terms
Payments are accepted via the following methods: credit card (Visa, Mastercard, American Express), PayPal, Interac by email, and bank transfer (for large projects).
All transactions are secured by SSL/TLS encryption. Tiguidou Création Web does not store any credit card numbers on its servers.
For professional services, a 50% deposit is generally required before work begins, with the balance due upon delivery or according to the schedule stipulated in the contract.
Any late payment of more than 15 days may result in the suspension of work and the application of interest at the rate of 2% per month (24% annually) on the unpaid balance.
6. Delivery of digital products
Digital products are delivered via immediate download after payment confirmation. A download link is sent to the email address provided when ordering.
The Customer is responsible for keeping a copy of its files. Tiguidou Création Web cannot be held responsible in the event of loss of files after downloading.
Download links are valid for 30 days from order confirmation. After this period, a reactivation request can be submitted to [email protected].
7. Delivery of professional services
Delivery times for professional services are specified in the quote or service contract. These deadlines are provided for information purposes only and may vary depending on the complexity of the project and the responsiveness of the Client in providing the required information and approvals.
Tiguidou Web Creation is committed to proactively communicating any anticipated delays and proposing reasonable solutions.
8. Cancellation and Refund Policy
If the Client cancels before the work has begun, the deposit paid is refundable, less the administrative fee of $75 CAD.Due to the dematerialized nature of digital products, no refund is possible after downloading, in accordance with article 54.4 of the Consumer Protection Act of Québec which expressly excludes goods whose nature does not allow return.
No refund of the deposit is possible once the work has started. The amounts invoiced will correspond to the work completed up to the date of cancellation.If the Client cancels before the work has begun, the deposit paid is refundable, less the administrative fee of $75 CAD.

9. Intellectual property rights
Unless otherwise agreed in writing, the intellectual property rights on the original creations (code, design, content) remain the property of Tiguidou Web Creation until full payment of the project. Upon receipt of final payment, the agreed usage rights are transferred to the Customer.The purchase of a digital product grants the Customer a personal or commercial use license (depending on the product description), non-exclusive and non-transferable. Resale, redistribution or making available of the files to third parties is strictly prohibited.
Tiguidou Création Web reserves the right to present the work produced in its portfolio, unless there is an explicit confidentiality agreement.Unless otherwise agreed in writing, the intellectual property rights on the original creations (code, design, content) remain the property of Tiguidou Web Creation until full payment of the project. Upon receipt of final payment, the agreed usage rights are transferred to the Customer.

10. Guarantees and limited liability
Products and services are provided “as is”. Tiguidou Création Web does not guarantee that the digital products are error-free or that they will meet all of the Client's specific requirements.
Within the limits permitted by law, the total liability of Tiguidou Création Web towards the Client, whatever the cause, may not exceed the amount paid for the product or service in question.
Tiguidou Création Web will under no circumstances be liable for indirect, consequential, incidental or punitive damages (loss of profits, loss of data, business interruption, etc.).
11. Confidentiality and protection of personal information
Personal information collected during transactions is used only within the framework of the commercial relationship and processed in accordance with Loi 25 (Act modernizing legislative provisions relating to the protection of personal information) of Québec.

12. Applicable law and jurisdiction
These General Terms and Conditions are governed exclusively by the laws of the province of Québec and Canada.
Any dispute arising from these General Terms and Conditions or in connection with them will be subject to the exclusive jurisdiction of the courts of the judicial district of Saint-François (Sherbrooke), Québec, Canada.
In the event of a consumer dispute, the Customer may also resort to the Consumer Protection Office (OPC) of the Québec.
13. General provisions
If one or more provisions of these General Terms and Conditions are declared invalid or inapplicable, the other provisions remain in full force.
The fact of not exercising a right provided for in these General Terms and Conditions does not constitute a waiver of this right.
These General Terms and Conditions constitute the entire agreement between the parties relating to their subject matter and replace any prior agreement, oral or written.
